I don't see how he got assault 2 for this. I don't know what state it was in. Also, your "sex in the car" defendant was acquitted. She had argued that she was not driving the car, because 1) she was having oral sex with the victim; but 2) a lot of expert testimony indicate that her injuries were not consistant with driver-side injuries. So, it wasn't a defense afterall.

Believe it or not this was in New York City- Staten Island is one of our 5 boroughs. I was there this weekend. But now I know to watch out for beef jerky wielding thugs! (but arent the slim jims soft beef jerky??)
