I'm not sure that Powe's point is as obvious -- or widely accepted -- as you think. See, e.g., Justice Scalia's A Matter of Interpretation. And perhaps, given his disdain for precedent, Justice Thomas as well.

I see LR more as a historical curio -- but one that showed the serious flaws of deductive law. Our eyes are open now.
